Research Skills for IP Litigation

This program discusses the unique requirements, procedures, and challenges encountered in complex IP litigation and the research tools available at each phase of litigation. Resources for pre-suit diligence, complying with court rules, drafting briefs, pleadings and motions, researching expert witnesses, calculating damages, and incorporating analytics into your litigation strategy will be discussed.

Learning Objectives:

I. Provide an overview of the unique aspects of intellectual property litigation and the landscape for intellectual property litigation today;

II. Discuss research techniques relevant to intellectual property litigation, including the importance of researching prior art, news, company information and agency filings, and how to locate relevant primary and secondary authorities for legal claims and defenses;

III. Understand how to leverage legal analytics to determine the most favorable venue, analyze a judge’s tendencies, vet experts, predict damages, reveal case resolution trends and support data-driven decision making.
