In Minerva Surgical, Inc. v. Hologic, Inc., 141 S. Ct. 2298 (2021), the Supreme Court narrowed assignor estoppel, a long-established equitable doctrine that bars a person who has assigned the rights to a patent or patent application from later challenging the validity of the assigned patent. Under Minerva, the estoppel does not apply so long as the validity challenge does not contradict any representations made concerning the invention at the time of the assignment.
